1. About these terms

These terms are for Mzansi Lift (mzansilift.co.za) ("Mzansi Lift", "we", "us").

An operator is a school-transport business with a Mzansi Lift account. The operator's owner accepts these terms for the business when signing up. A parent is a parent or legal guardian who joins an operator through its join link. By using Mzansi Lift you accept these terms.

2. What Mzansi Lift is, and is not

Mzansi Lift helps an operator see who is riding each day, receive parents' changes, send notices, and let drivers tick pick-ups and drop-offs; it helps parents follow their children's trips and tell the operator about changes.

  • The operator, not Mzansi Lift, provides the transport and remains fully responsible for the children in its care, its vehicles, drivers, licences, permits and insurance.
  • Mzansi Lift is not an emergency service and not a tracking system. A tick shows what the driver tapped, not where a child is. In an emergency, or for a change after the operator's cut-off time, phone the operator.
  • Messages and notifications can be delayed or not arrive (for example when a phone is off or has no signal).

3. Accounts and security

  • Give true details and keep them up to date.
  • Keep your password private; turn on two-step login if you can. Tell us at once if you think someone else has used your account.
  • An operator login belongs to one business. A parent with children at two operators has one login and a separate membership at each.
  • Operators keep driver links and PINs private, and change them when a driver leaves or a phone is lost.

4. Operators: your obligations

  • Use Mzansi Lift only to run your own school-transport business, and only for the parents and children you transport.
  • Approve or add only children you actually transport, and keep their status (active, paused, removed) accurate.
  • Comply with the laws that apply to your business, including POPIA (see section 5) and road-transport law.
  • Give drivers access only to what they need, and make sure they use the app only while the vehicle is stationary.
  • Pay invoices when due (sections 6 to 8).

5. Data protection (POPIA operator agreement)

This section is the written agreement that POPIA section 21 requires between a responsible party and its operator. In it, "processor" means a POPIA operator, to avoid confusion with transport operators.

Roles

  • You (the transport operator) are the responsible party for your customer records: the parents and children who join you, their profiles, children's details, updates, ticks, notices and your activity log.
  • Mzansi Lift is your processor for those records. We process them only on your behalf, to provide Mzansi Lift as described in these terms and the privacy notice.
  • Mzansi Lift is the responsible party for its own billing data (invoices, statements, payments, card tokens) and for platform accounts (logins, two-step login, security records, push subscriptions).

What we promise as your processor

  • We process your customer records only to provide the service, on your instructions as given through the app and these terms, unless the law requires otherwise.
  • We keep them confidential (POPIA section 20): only people who need access to support you or run the service have it, and they are bound to confidentiality.
  • We keep appropriate security measures (POPIA section 19), including encryption in transit, encryption of sensitive fields at rest, database-enforced separation between operators, logs without personal details, and backups. The privacy notice lists them.
  • We use the sub-processors listed in the privacy notice and tell you before adding or replacing one.
  • We notify you immediately if we have reasonable grounds to believe that your customer records were accessed or acquired by an unauthorised person (POPIA section 21(2)), and help you notify the Information Regulator and affected parents.
  • We help you respond to parents' requests. Parents can download, correct and delete their own data in the app; tell us about anything else.
  • We apply the retention periods in the privacy notice, and when your account is closed we keep or delete your customer records as section 9 says.

What you promise

  • You have a lawful basis for the records you hold in Mzansi Lift. Parents give consent for their children when they add them. When you add a child yourself, you confirm that the parent or guardian agreed, and you must be able to show that they did.
  • You tell parents that you use Mzansi Lift, for example by sharing your join link and our privacy notice.
  • You use the records only to transport the children, and you do not copy them out of Mzansi Lift for other purposes.
  • You tell us at once if you suspect a breach of your account.

6. Pricing

  • The price is R20 per child per month. Parents pay nothing to Mzansi Lift.
  • A child is billed for a month if they were Active on at least one day of that calendar month (South African time). Pending, paused, declined and removed days do not count, and a child counts only once a month, even if removed and added again.
  • Grace: a child removed within 48 hours of first becoming active is not billed. This applies once per child, to cover approvals made by mistake.
  • First payment: when you sign up you pay for the number of children you declare (declared children × R20). This is a credit against your first month. If you have more children than you declared, the difference is added to the next invoice; if fewer, the unused credit carries forward one month and then expires. It is never refunded in cash. If you sign up after the 20th, your first period runs to the end of the following month.
  • Monthly minimum: we may set a minimum monthly amount for an account. None applies unless your account shows one; we give at least 30 days' notice before introducing one.
  • VAT: Mzansi Lift is not VAT-registered, so no VAT is charged. Once we register, VAT at 15% will be added to the price, and we will tell you before it applies.
  • Trials and free access are granted only by Mzansi Lift, in writing, and are shown on your billing page.
  • We may change the price with at least 30 days' notice by email. A special price agreed with you is shown on your billing page.

7. Billing and payment

  • Payment is by card through PayFast. When you pay, PayFast saves a token for your card so the monthly invoice can be charged automatically. We never see or store your card number.
  • Invoices are issued on the 1st of each month for the previous month and are due on the 3rd. If an invoice is held for review (for example when our daily counts and the month's records disagree), it is due 3 days after we release it, and never before the 3rd. Each invoice lists every billed child, with the first and last active day, and comes with a printable statement and a CSV.
  • Your card is charged on the due date. If a charge fails, we try again 3, 5, 7 days after the due date, and email you each time.
  • Invoices are never edited. If an invoice is wrong, tell us within 30 days at info@mzansilift.co.za; any correction is made with a credit note.
  • The billing page shows a live count of what your next invoice will be.

8. Late payment: Restricted and Suspended

  • 7 or more days overdue: Restricted. You cannot approve or add new children, and a banner shows on every page. Everything else keeps working: the Today board, updates, notices and driver links, so no child is affected.
  • 21 or more days overdue: Suspended. Your access becomes read-only. New parents cannot join you through your join link, and parents cannot add children or send updates; they can still see their children's schedules, remove a child or correct their child's details. Drivers keep working, and you can still change a driver link or PIN.
  • Access is restored straight away once all overdue invoices are paid. Use Pay now on your billing page.

9. Cancelling and closing an account

  • Operators can cancel at any time by emailing info@mzansilift.co.za. Remove your children first if you can: any month in which a child was active is billed, and the final invoice is still payable. Unused credit is not refunded.
  • When an operator's account is closed, its parents can no longer see that operator in the app. Billing records are kept for at least 5 years, as the law requires; the operator's customer records are kept under the retention periods in the privacy notice and then deleted or reduced to counts. Ask us before closing if you want a copy of your records.
  • Parents can delete their account at any time from My data.
  • We may suspend or close an account that breaks these terms, puts children or other users at risk, or stays unpaid; where possible we warn you first and give you time to put it right.

10. Parents

  • Mzansi Lift is free for parents. Your agreement for the transport itself, and its fees, is with your operator, not with us.
  • Add only your own children, or children you are the legal guardian of, and keep their details (addresses, authorised collectors, school days) correct.
  • Your operator approves your children, and can pause or remove them.
  • For a change after the operator's cut-off time, the app alerts the operator, but please also phone them.

11. Acceptable use

Do not:

  • use Mzansi Lift for anything unlawful, or to harass, threaten or mislead anyone;
  • try to see information you are not meant to see, including other operators' or other parents' data, or test, probe or attack the service's security;
  • share your login, driver links or PINs with anyone who should not have them;
  • upload malicious code, or overload the service (for example with automated requests);
  • copy, resell or build a competing product from the service.

If you find a security problem, please tell us at info@mzansilift.co.za.

12. Availability and liability

[[STEFAN: attorney review of the liability clauses]] This section is a draft and must be reviewed by an attorney before launch [review with attorney].

  • We work to keep Mzansi Lift available and correct, but we provide it "as is" and cannot promise it will always be available or free of errors. We may pause it briefly for maintenance.
  • To the extent the law allows, Mzansi Lift is not liable for indirect or consequential loss (such as lost profit), or for loss caused by the operator's transport, drivers or vehicles, by a parent's or operator's inaccurate information, or by delayed or missing messages.
  • To the extent the law allows, our total liability to an operator in any 12 months is limited to the fees that operator paid us in those 12 months. Parents use the service free of charge.
  • Nothing in these terms limits liability for gross negligence, wilful misconduct, or anything else that cannot lawfully be limited, including rights under the Consumer Protection Act, 2008 where it applies.
  • Each operator is responsible for claims arising from its own transport service and its use of Mzansi Lift in breach of these terms.

13. Changes to these terms

We may change these terms. We publish each new version here with a new version number and effective date, and email operators at least 30 days before a change that affects them materially. Continuing to use Mzansi Lift after that date means you accept the new version.

14. South African law

These terms are governed by the law of the Republic of South Africa, and South African courts have jurisdiction. If any part of these terms is found invalid, the rest still applies.
